    LearnSimpl – Terms of Use

    Welcome to LearnSimpl.com (“LearnSimpl”, “we”, “us”). These Terms form a binding agreement between you and LearnSimpl. By creating an account or using our site, you agree to these Terms and to our Privacy Policy.

    1. Accounts & Eligibility
      • You need an account to enrol in courses. Keep your password secure; you’re responsible for all activity on your account.
      • You must be 18+ to create an account (or use the platform under a parent/guardian’s account if you’re under 18, where legally allowed).
      • We may suspend or close accounts that breach these Terms or the law.

    2. Enrolment & Access
      • When you enrol, you receive a limited, personal, non-transferable licence to view the course via LearnSimpl only.
      • You may not resell, share, record, download, or redistribute course content.
      • We may remove or disable access to content for legal, safety, or policy reasons.

    3. Payments & Pricing
      • Prices may appear in your local currency where supported; taxes may apply at checkout.
      • You agree to use a valid payment method. If payment fails, we may restrict access until amounts are paid.

    4. Refunds (South Africa)
      • Cooling-off: If you purchased because of direct marketing, you may cancel within 5 business days under the Consumer Protection Act (CPA). For electronic transactions covered by the Electronic Communications and Transactions Act (ECTA), a 7-day cooling-off applies. Where both could apply, the longer cooling-off recognised by law will apply.
      • Digital content: Once a digital course is accessed/streamed/downloaded, change-of-mind refunds may not apply. Statutory rights (e.g., not as described, defective service) remain under the CPA.

    5. Content & Conduct
      • Keep all activity lawful, respectful, and original. Don’t upload or share anything unlawful, infringing, harassing, harmful, or privacy-invasive.
      • Do not copy, scrape, reverse-engineer, attack, or interfere with the site or its security.

    6. Your Content (reviews, posts, submissions)
      • You retain ownership of content you post. You grant LearnSimpl a worldwide, royalty-free licence to host, display, adapt, and promote that content in connection with the Service.
      • Don’t post third-party content without permission.

    7. AI-Powered Features
      • Inputs & Outputs: You own your Inputs. LearnSimpl grants you a licence to use AI Outputs for personal learning on LearnSimpl.
      • Don’t include sensitive personal information in prompts. Don’t use AI features to mislead, harm, or violate laws or rights.
      • We do not use your personal data to train third-party models unless we have a lawful basis and provide opt-out/consent where required.

    8. Privacy, POPIA & PAIA
      • We process personal information lawfully, minimally, and securely as required by POPIA (purpose limitation, collection limitation, openness, security safeguards, and data subject rights to access/correct/delete where applicable).
      • Cross-border transfers occur only with adequate protection or other lawful grounds under POPIA (e.g., consent, contractual necessity).
      • You can request access to records via our PAIA Manual and contact our Information Officer (see contact details below).

    9. Intellectual Property
      • All LearnSimpl trademarks, branding, code, and site content (excluding user content) belong to LearnSimpl or its licensors. You may not use them without permission.

    10. Certificates of Achievement

      LearnSimpl provides Certificates of Achievement to recognize successful course completion.

      These certificates are intended to celebrate your learning progress and demonstrate personal or professional development.

      LearnSimpl certificates are not accredited, certified, or formally recognised by the South African Qualifications Authority (SAQA), Council on Higher Education (CHE), or any government-regulated body.

      They do not confer academic credit, formal qualification, or professional designation.

      Employers or institutions may, at their discretion, recognise a LearnSimpl certificate as evidence of effort or skill development, but LearnSimpl makes no guarantees of external recognition.

      By enrolling, you acknowledge that LearnSimpl courses are designed for self-improvement, practical learning, and habit-building, not for regulated qualification pathways.

    11. Third-Party Services
      • We may integrate payment processors, analytics, video hosting, or communication tools. Your use of those services may be subject to their own terms and privacy notices.

    12. Disclaimers & Risk
      • Courses are provided “as is” and “as available.” We make no guarantees of specific outcomes.
      • Some courses may relate to fitness, wellness, or other activities that carry risk. Use your judgement and consult professionals where appropriate.

    13. Limitation of Liability
      • To the extent permitted by South African law, LearnSimpl won’t be liable for indirect or consequential loss.
      • Our total liability for all claims in any 12-month period won’t exceed the amount you paid to LearnSimpl for the course giving rise to the claim.
      • Your statutory rights remain unaffected.

    14. Termination
      • You may close your account at any time. We may suspend or terminate access for legal, safety, or policy reasons, or for non-payment.
      • Clauses on IP, licences, disclaimers, limitation, and governing law survive termination.

    15. Governing Law & Disputes (South Africa)
      • These Terms are governed by the laws of the Republic of South Africa.
      • Disputes will be brought in the courts of South Africa.
      • Nothing limits your rights under South African consumer law.

    16. Changes to These Terms
      • We may update these Terms to reflect new features or legal requirements. We will display the updated date and, for material changes, provide prominent notice. Continued use means you accept the changes.
